my car was hit on the back bumper which have some old damage on it?
my car was hit by a lady from the back when i was stopping in front of the traffic light. my car was towed to do the inspection, and I paid the towing fee$300.
Later i found all the information she provide is fake. the police helps me to find her out. i ask her to pay the amount of the quotation. there is some old damage on the bumper. i told the smash repair center about that old damage. and the smash repair center give me a quotation around $3000. they told me this crash make the internal damage and the bumper have to be replaced..(it can see there is more damage on the bumper. the end of the bumper is loose and a gap appear)
Finally she pay the excess to the insurance company. but the staff of the insurance company say all are old damaged. they only paid me for the paint of scratch $500.
1.what can i do if i am not accept that condition?
2.can i ask them to pay the towing fee?
3.do i have the right to ask them to fix the bumper panel?

Good job admitting to the old damage – seriously! Adjusters find this stuff out and had you done this without telling them, you’re bordering on Insurance Fraud there. Happens all the time, yes, but it’s a felony you don’t want to play with.
You do have some rights here though. Demand that the insurance company present you with some proof that the massive damage -wasn’t- done by this new accident. If they can’t tell you that it’s not, threaten them with a lawyer. Most companies will do anything to avoid a costly lawsuit. If that doesn’t work, then go get one.
As for the tow, yes, they are obligated to pay that expense. Send them the receipt and tell them that they need to pay it.
